QUESTION: Ms Speedy, a 30-year old female cyclist, is deeply in love with Mr
Muscles, a 17year old boy who has recently started cycling. Mr Muscles does not
welcome the attention he receives from Ms Speedy but agrees to go cycling with
Ms Speedy on a deserted dirt road close to a dam. Ms Speedy’s plan is to cycle

OFFENCES WITH WHICH MS SPEEDY MAY BE CHARGED
1. Assault, Common Law
Ms Speedy committed assault on two occasions. by forcing Mr Muscles to drink beer
against his will, she applied indirect force to his person. In S v A 1993 (1) SACR 600 (A)
, the court held that forcing another to drink any substance against their will constitutes
assault. Then by intentionally kicking the bicycle wheel, causing Mr Muscles to fall into
the dam, she directly applied force to his person. The act was
unlawful (no consent) and intentional (she acted out of fury).
