citizens to gain access to land on an equitable basis. With this in mind, mention
and discuss the measures that have been introduced to address the needs of the
landless.
In South Africa, land reform is a constitutional duty. Section 25 of the Constitution (The
property clause) protects existing property rights but also creates a duty for the state to
fix the land injustices of the past. Apartheid laws like the 1913 Natives Land Act and the
Group Areas Act forced many Black South Africans off their land.
Section 25(5) of the Constitution is the key instruction. It says the state must take
reasonable steps, within its resources, to help citizens access land fairly.
