Read the fictitious scenario below and then discuss whether Ricky’s behaviour
constitutes conduct for the purposes of delict.
Ricky is a mechanical engineer working for a large construction firm. One
afternoon, he leaves the site earlier than usual to pick up his child from school.
Before he departs, he notices that the scaffolding equipment on the site has not
been fully secured. However, he decides not to address the issue, assuming that
the workers on the next shift will complete the installation. That evening, strong
winds caused parts of the unsecured scaffolding to collapse onto the pavement
outside the construction site. A pedestrian named Colby was struck by falling

defined as a voluntary human act or omission, which forms the damage-causing event.For Ricky’s behaviour to be classified as delictual conduct, it must be established that
