Summary of the Facts
Quantum Foods (Pty) Ltd sought to align its employees’ wages with the National
Minimum Wage Act 9 of 2018 (the Act). To achieve this, it restructured its payslips to
include a contractual bonus and employer contributions to a provident fund, ensuring
that the total remuneration met the statutory minimum wage requirements. The
General Workers Union of South Africa (the union) challenged this approach, arguing
that these payments should not be factored into the minimum wage calculation. The
