Construction Workers Union (‘CWU’) and Construction Experts (‘CE’) conclude a closed shop agreement which is effective from 1st April 2025. Ben is employed by CE as a supervisor with effect from 1st May 2025 and amongst others his appointment letter informs him that he is required to join CWU as a member within 30 days of employment. After three (3) months, Ben has still not joined CWU as a member.

A) Discuss whether CE can dismiss Ben for not joining CWU.

B) Briefly discuss how a dispute about the interpretation of the closed shop agreement above is resolved.
