ASSIGNMENT QUESTION
Unity for Workers Union (‘UFWU’) is a majority trade union with members in Fancy Fabrics (Pty) Ltd (‘FF’), a company which manufactures and sells clothing in all South African Provinces. At the beginning of May 2024, UFWU and FF concluded a closed shop agreement. Draw a distinction between a closed shop agreement and an agency shop agreement.
Under the South African Labour Relations Act (LRA) 1995, both agreements aim to strengthen unions but differ significantly in their requirements and implications:
1. Closed Shop Agreement
A closed shop agreement is a type of union security arrangement that requires all employees in a particular workplace to join the union as a condition of employment. This agreement essentially ensures that the union is the sole representative for the employees in that workplace.
Union Membership Requirement
Under a closed shop agreement, only union members can be employed. Employees who are not members of the union cannot be hired by the employer. Furthermore, if an employee is already working in the workplace, they must join the union within a certain period after being hired to continue their employment.
