a) Difference Between Assent and Commencement with Reference to Section 13 of
the Interpretation Act 33 of 1957
The process of enacting legislation follows several stages. The Act in question was:
Adopted on 5 April 1996 – This means it was passed by the legislature.
Assented to by the President on 10 April 1996 – This means the President approved
the Act by signing it into law. However, this does not mean that the Act automatically
came into operation.
Commenced on 19 June 1996 – This is the date when the Act became legally effective.
According to section 13(1) of the Interpretation Act 33 of 1957, the term
“commencement” means the day on which a law comes into operation¹. If no specific
commencement date is provided in the legislation, the default rule is that the Act comes
into effect on the date it is published in the Government Gazette².
