QUESTION 1 PRINCIPLES OF ADVOCACY FOR DISABILITY 30 MARKS Jane has an intellectual disability and a mental health diagnosis. She was living in unsuitable accommodation and was worried she might become homeless. One of her parents had died some time ago and there was a breakdown in her relationship with her family. She was unaware of her welfare entitlements and was not linked with any support services. Her parents’ outstanding bills had been transferred to Jane and left her in debt. Jane also believed that her family violated her rights and entitlements regarding her parent’s estate. Jane told her advocate that her family had attempted to exclude her from her parent’s estate. She needed help to access not only social welfare, but also housing, legal, disability, and social support. Although Jane preferred to stay on in her parent’s house, it was unsuitable to her needs and deemed unsafe. EDS4804 2025 ASSIGNMEN NO.2 7 Jane found accommodation in another area but wanted to return to the area she had known all her life. The advocate worked with Jane to agree on an advocacy plan for her accommodation needs. Her advocate supported Jane with where she wanted to live and offered her information about her financial and inheritance rights, including clarification of who was responsible for paying her parents’ debts. The advocate helped Jane to gather all the outstanding accounts and communicate with service providers. Jane discovered that most of the debts were outstanding before she had agreed to transfer the accounts to her name. Her advocate helped her to obtain records that show she had already moved out when some of the debt had accumulated. The advocate applied on her behalf for a transfer to new accommodation and to have the outstanding debts cancelled. Money she had paid to clear the debts was refunded. Her advocate also helped Jane to get free legal aid and draft a letter requesting information about her inheritance and address it to her parent’s solicitor. Thanks to these actions, Jane’s rights to an equal share in her parent’s estate were restored. Her advocate also helped Jane to get a disability allowance, social welfare support, and a medical card.
