South African criminal law recognises the doctrine of common purpose. The doctrine makes it
possible, in certain circumstances, for more than one person to be held criminally liable for the same
crime, even though not every participant personally carried out every act that resulted in the
commission of the oence.
The Constitutional Court considered the doctrine of common purpose in S v Thebus and Another
2003 (6) SA 505 (CC). The Court examined the nature and purpose of the doctrine and considered
whether it is consistent with the Constitution of the Republic of South Africa, 1996.
