QUESTION 1:
Carefully consider the following pronouncement made by Martin Luther King Jr. in
his famous “Letter from Birmingham Jail” on 16 April 1963:
One may well ask: “How can you advocate breaking some laws and obeying others?”
The answer lies in the fact that there are two types of laws: just and unjust. I would
be the first to advocate obeying just laws. One has not only a legal but a moral
responsibility to obey just laws. Conversely, one has a moral responsibility to disobey
unjust laws.
1
Identify the legal philosophical approach that Martin Luther King Jr. advocates in his

falling asleep, got out of bed on 19 April 2025 at 03:30 and went to the property that
he rented from X, where he started working at 04:00. Y claims that X’s conduct is in
contravention of a contractual clause stipulating that “[t]he rented property can only
be occupied during working hours”. X claims that Y occupied the property outside of
“working hours” and is thus in breach of contract. In considering whether a breach of
contract occurred, the magistrate decided as follows:
“I often experience a surge of energy in the evening after dinner and proceed to write
inspired judgments. These are indeed “working hours”. I do not let a clock dictate
when I can work and when I cannot work. The same should hold true for Y. There is
no breach of contract in this case.”
Name and extensively discuss the theories that best explain how the magistrate
