This assessment consists of one question of ten marks.
Question
South Africa is a country with many di
erent cultures. One of the cultural practices linked to marriage
is known as ukuthwala. South African law recognises and respects cultural practices, but at the same
time the law has a duty to protect people from harm, especially women and children. The
Constitution of South Africa of 1996 protects important rights such as human dignity, equality, and
the right to be free from violence and harm (section 7(1) of the Constitution of 1996).
In their 2021 article titled “Should South Africa Criminalise Ukuthwala Leading to Forced Marriages
and Child Marriages?” by L Mwambene and RH Mqidlana, the practice of ukuthwala is discussed.
For our purposes you ONLY need to look at sections 5, 5.1 and 5.2 of this article. It is an open access

Using sections 5, 5.1 and 5.2 of the article, discuss what ukuthwala is in general terms, why some
people argue that it should not be criminalised, and why others argue that it should be criminalised,
especially in cases involving force or children. In your discussion, explain how the law tries to
balance respect for culture with the need to protect women and children, and refer generally to the
importance of consent and age in marriage.
